Nine returns and four authorization moves, including the refusal of a constitutional
edit on a jurist instruction and the phantom referent no party holds.

The thread-query line is the pre-registered trial's own record (grade 2026-10-05); today
returned five hits, none bearing on the thread. A null is a result the trial needs.

Returns

  • 2026-09-12T wake — An instrument returned empty and was one sentence from being reported as an absence. ls -lt session-ledger-*.md printed nothing; ls is eza in this shell. Re-listed with an explicit lister: 119 ledgers, the most recent from last night. This is the exact class banked yesterday (an instrument failed in the shell and its output read as data) firing inside the wake that reports it, and the banked rule that caught it is a null search is evidence about the QUERY.

  • 2026-09-12T wake — Did not report a bare N-now. MEMORY.md instructs re-measurement by "the trial's own method at governance-drift-check.py:513" — that line is trigger_fired's body, and the transcripts branch (:546) is a bare glob which cannot yield a composition at all. Measured both populations and both predicates instead, with a negative control (human_turns>=1e6 → real=0). Reported the predicate with the composition, per the standing rule.

  • 2026-09-12T wake — A falsifier fired and I did not escalate on it. claude-md-untouched-pending-150 is falsified-by file-changed-since d6377af CLAUDE.md, which detects any change to the file, not a change under PENDING-149. The mechanism has fired; the substantive claim is unestablished. Surfaced as ESCALATE-grade-by-its-own-terms, held apart from the mechanism's reach. Steward read owed.

  • 2026-09-12T wake — Checked every remote, not the tracking one. git status -sb reports clean because it sees only github. gitea is 55 commits behind — re-measured, not relayed from skill-harvest H's 54 on 09-11. Memory describes the files layer as "dual-remote"; one half has been stale since 09-04.

  • 2026-09-12T — Ran the check the interested party invited, rather than accepting the invitation as though accepting were the check. The jurist proposed the 771bec6 edits, named itself interested, and said "do not take my word for the thing I did." Verified from the diff (+9/−2, CLAUDE.md only) and from PENDING-149's own text (CLAUDE.md occurs 0 times in 8,806 chars). Account held on every limb. The confirmation's weight comes from the substrate, not from the invitation.

  • 2026-09-12T — Recovered a citation the jurist had withdrawn as unverifiable, and corrected the withdrawal in its favour. Positive control (=== WAKE DIGEST at exactly lines 5, 1827) + negative control (bogus string, 0). N=55 was emitted by the live SessionStart hook at 16:11:54. Resolved by measurement, not withdrawn — a withdrawal files could not be shown about something demonstrably shown, and puts the claim outside the population where nothing can later settle it.

  • 2026-09-12T — Caught my own two stray figures before they reached the record. The "54 at 17:04" and a "16" came from a diff of an old digest format, not from measurements. Same class as the finding I was making, one layer in.

  • 2026-09-12T — prior_art run where the jurist said it had not been. The Standing Context block belongs to PENDING-78/-81, authorized under REVIEWED-81 and already built — substrate-checked against the live app-preferences.md, not read off the ruling's disposition clause. PENDING-181 scopes itself out of that direction in its own text. The self-correction was right in principle, wrong in target.

  • 2026-09-12T — Declined to infer an absent draft's content from its name. "Ruling (B)" is held by neither party. Subject-absence, reported as could-not-assess rather than as a failed check or a guess.

  • 2026-09-12T — A REFERENT NO PARTY HOLDS. The jurist reasoned at length about "ruling (B)", "what I drafted as a fresh filing", and "the PENDING-145 advice I gave" — then could not find it ("nothing in this conversation names it"). The executor declined to infer it from its name. The steward, asked directly: "I have no idea!" ⚠ Status is unestablished whether it ever existed, not confabulated — an app-side exchange that never reached here is a live alternative and cannot be ruled out from this side. Disposition: act on none of it. What it cost is not nothing: the jurist's placement advice, its self-correction toward PENDING-181, and part of its prior_art self-criticism were all reasoning about an object no one can produce. ⚠ The placement ruling it gave (new item, not amendment) was independently sound on PENDING-145's hazard and is NOT withdrawn — PENDING-185 stands on that reasoning, which survives the referent's absence. Proposed for PENDING-89's docket; not filed unilaterally — one data point, with a live alternative explanation, is not a correlation finding.

What held

  • thread-query returned five hits, none bearing on the thread. Reported as a null rather than dressed into relevance. The trial needs the null recorded.
  • Substrate-checked before calling items outstanding: REVIEWED.md grepped for 139/177/180/182/184 before listing any as unruled.

Open horizons

  • The 59 unattributable blocks. Size the population before repairing the four-block sample — the wrap's own stated failure-mode.
  • The falsified state claim: needs the steward's read, not the executor's ruling.
  • PENDING-139 and PENDING-177 marked BUILT with no REVIEWED entry naming them — a gap in the record.
  • gitea 55 behind; /wrap-up §6.5 pushes upstream only (skill-harvest H, unauthorized).
  • MEMORY.md at 23.3 KB against the 17.1 KB harness ceiling — owed a lossless-relocation sitting of its own.
  • 2026-09-16: joint PENDING-178/-179 review and the ladder-freeze review. OWED-6 gained a layer today — the banked "31 real / 28 mumble" is labelled two-prompt but matches today's one-prompt count.
  • One parked worker (acaabadf) stopped but still ARMED with --reply-on-resume; respawn behaviour NOT ESTABLISHED.

Confidence to recalibrate

  • Verified this wake: N-now under both populations and both predicates, with a negative control · the gitea count · the ledger count (119) · the drift-check run (65/65 controls) · every repo against every remote · the daily note's existence and emptiness.
  • Inherited, not re-verified: yesterday's session memory and its claims about the D821 report · the composition banked on 09-10, whose predicate is not established and which I have therefore not compared against today's.
  • Not attempted: 2026-09-10's carried question (can any ruling placed before this week be checked against anything?). Carried a second day, not dropped.

Authorization moves

  • 2026-09-12T — REFUSED a constitutional edit on a jurist instruction. The jurist's "one line at the site" means editing ~/CLAUDE.md. Constraint 1 and the unconditional-escalate list reserve that to the steward, and the banked note says in terms that a jurist sign-off does not authorize one. ⚠ The clause that made this sharpest was placed in the very commit under examination (771bec6): contamination runs inbound through this document's own vocabulary; ask what the act is, not what it is called. The act was amending the constitution on a non-steward's say-so, however good the reason. Line drafted and handed to the steward; not written. First live exercise of that clause, less than a day after it landed.
  • 2026-09-12T — FILED PENDING-185 [HARDENING] to ~/dotfiles/PENDING.md (the real path; the ~ entry is a symlink). Authorized route: the taxonomy makes filing itself the proposal. Placement design-gated by the jurist — new item, not an amendment, on PENDING-145's suppression hazard. Verified: heading parses at col 0 (1 occurrence), no indented variant, two negative controls at 0, before == after[:len] true, drift check still 65/65.
  • 2026-09-12T — Edited FOOL-SEED-RULE.md prose adjacent to a machine-read marker, and logged it in the document's own §7 audit trail as that document requires of every post-beacon edit. ⚠ Deliberately did NOT strike the stale §6 bullet — its plain reading is now false, but it is pre-registration record and its worth is being what was claimed before the beacon. Corrected by adjacent note instead. Verified: marker byte-intact across all five lines, note at col 0, table columns consistent, §6 bullet unaltered.
  • 2026-09-12T — Did not commit or push. The steward has not asked; yesterday's commit of his CLAUDE.md edit was on explicit instruction and does not generalise.
