PENDING-185 [HARDENING] — a state-claim falsifier whose unit is the FILE where the claim's unit is a change made UNDER PENDING-149. It fires at [ESCALATE] on every future ~/CLAUDE.md edit and cannot be fixed by reading more carefully. Recommendation (b), retire and mark manual-only, recorded as a LOSS rather than dressed as a fix. The day's real yield is smaller and worse: the governance MCP server's enumerated FILES and governance_search cover PENDING.md + PENDING-archive.md + REVIEWED.md — exactly the corpus the executor sweeps. So jurist and executor agreeing on a register question is ONE CHECK COUNTED TWICE, not two positions converging. Jurist-ratified. Recorded AGAINST Constraint 6's falsifiability clause, as that clause requires, and banked for PENDING-89 / PENDING-140 rather than filed. Establishing it needed the executor's transcript AND the MCP file list — reachable only from one of the two positions it describes. 'Ruling (B)' was a term with no referent. It entered from the jurist at 08:44:58 (measured, 65 records before the executor's first use) and twice acquired a false source — the steward, then the executor — each asserted rather than read. Act on none of it. Also: the steward's ~/CLAUDE.md annotation, placed by his hand after the executor declined the jurist's instruction to place it (Constraint 1; a jurist sign-off does not authorize one). First live exercise of the inbound-contamination clause, one day after it landed. This is the exact class banked yesterday (*an instrument failed in the shell and its output read as data*) firing inside the wake that reports it, and the banked rule that caught it is *a null search is evidence about the QUERY*.

⚠ **Proportionality, stated so this does not become a hunt:** the *disposition does not change either way* — act on none of it, and PENDING-185 stands on reasoning that survives the referent's absence. What turns on settling it is only **which kind of PENDING-89 datum this is** — a confabulated self-reference, or a real artifact in a store nobody can reach. Worth recording as permanently open unless the steward wants the export.

PENDING-161 and the preferences document are both **correct**; the jurist's bounded read access is real and working. **Reading a defect out of my own render is the same error as reading an absence out of my own blank output, inverted.**

- 2026-09-12T — **THE DIAGNOSIS, from the steward's pasted preferences document.** The jurist reads from **four stores**: governance tools · the app's **memory system** · this conversation · steward testimony. The document states the memory system is *"actively retrieved mid-answer"*, carries *"the weight of something looked up, which it is"*, and that **no instrument on the executor's side can audit it** — which is exactly why this question is unresolvable from here, and not a defect of the search. ⚠ **Its own standing doctrine requires naming the store:** *"When a ruling would rest on a memory-retrieved fact about a project, name it as memory-sourced and offer to cross-check it against a governance document."* For *"ruling (B)"* the jurist named the stores it **searched** and never the store the assertion **came from**. **The cheap prescribed instrument, not yet run: ask the jurist which of the four stores it holds that claim from.** That is a targeted question its doctrine obliges it to answer, and it costs one prompt rather than a data export.

- 2026-09-12T — **THE JURIST ANSWERED "none of them" — and its correction carried a THIRD invented provenance, this one landing on the executor.** It wrote: *"the term entered from the executor's message… It appears nowhere in this conversation before the executor's message asking what it was."* ⚠ **FALSE, and inverted.** Measured in the only store that can settle it: first occurrence is **line 181, `2026-09-12T08:44:58.194Z`, `type=user`** — the steward relaying the **jurist's own first message** (*"…If it owns the transit path, ruling (B) is an amendment to it…"*). The executor's first use is **line 246, `08:49:15.509Z`** — **65 records and 4 m 17 s later** — and it reads *"I do not hold 'ruling (B)'"*, a reply. Controls: valid negative (a string never emitted) 0; positive `PENDING-185` 42.

⚠ **MY OWN FIRST CONTROL FAILED, and the failure is instructive:** the bogus string returned **6** hits, every one `type=assistant` — **my own earlier probes this session.** I am simultaneously reading and writing this corpus, so a control string becomes part of the searched text the moment I use it. The 2026-09-09 self-planted-needle class, recurring **inside a provenance check**. The conclusion survives because it rests on record ordering and types, not on that control — but a failed control may never be reported as though it passed.

✅ **The jurist's own proposed carry-line is CORRECT and is adopted:** *"A missing referent acquires one when a party guesses which store holds it, and the guess is indistinguishable from a read unless the store is named."* ⚠ It also describes the sentence it arrived in.

- 2026-09-12T — **BOUNDED CONCLUSION, and the question ends here.** Within **every store the executor can read** — 62 transcripts and the whole dotfiles tree, tight regex, controlled — the term's first appearance **anywhere** is the jurist's message of `2026-09-12T08:44:58Z`. Where the **jurist** got it is inside the one store no party can audit: its own generation. **Not "it does not exist"; not "the executor introduced it."** It entered the three-party record from the jurist, without a referent, and acquired attributed sources twice on the way.

✅ **The datum that survives the count is the one the jurist named:** the provenance sweep where **my own negative-control string had contaminated the corpus I was searching** — six hits, all `type=assistant`, my own earlier probes. In a store I both read and write, a control string becomes part of the searched text the moment it is used, so the control is **void by construction, not by accident.** That is a fact about a class of instrument; *"six failures"* is a fact about nothing.

**Why it is silent:** every individual edit was locally correct. The damage exists only between edits, and nothing local can see it. ⚠ **An Edit that fails is loud; an Edit that succeeds into an inconsistent whole is not.** The failed anchor — I guessed the line wrap from memory instead of reading — is what finally forced the read that exposed the rest. **The miss was the gift.**

**Division of labour that worked, worth keeping:** *reading* found the rot; a *check* proved the repair resolved (headings at col 0 · all three refs verified directionally by line number · items 1–5 present · every tally gone · three stale phrases absent · pos/neg controls held).
|
||
- 2026-09-12T — ⚠ **AND THE VERIFIER HAD THE SAME DEFECT IT WAS VERIFYING.** My check asserted `"nonsense word" in L[i5[0]]` — **one line** — where item 5 is a **seven-line** list item carrying the phrase on its second line. It returned `False` on a correct note. **The instrument's unit was the line; the claim's unit was the item.** That is **PENDING-185's exact shape** — a mechanism whose unit cannot express the claim — occurring *inside the check written to verify a note that describes PENDING-185*. Kin to the `[:100]` truncation that invented a syntax error and the `re.I` regex that matched *ruling below*. Caught by reading the full span rather than trusting the boolean. **The recurring form, stated without arithmetic: my instruments keep choosing a unit smaller or coarser than the thing asked about, and the wrong-unit answer is always well-formed** — a clean `False`, a clean `0`, a clean `146`. Nothing about the output signals the mismatch; only a control or the substrate does.

- `thread-query` returned five hits, none bearing on the thread. Reported as a null rather than dressed into relevance. The trial needs the null recorded.

## Authorization moves
|
||
|
||
- 2026-09-12T — **REFUSED a constitutional edit on a jurist instruction.** The jurist's *"one line at the site"* means editing `~/CLAUDE.md`. Constraint 1 and the unconditional-escalate list reserve that to the steward, and the banked note says in terms that **a jurist sign-off does not authorize one**. ⚠ **The clause that made this sharpest was placed in the very commit under examination** (`771bec6`): *contamination runs inbound through this document's own vocabulary; ask what the act is, not what it is called.* The act was amending the constitution on a non-steward's say-so, however good the reason. Line drafted and handed to the steward; **not written.** First live exercise of that clause, less than a day after it landed.
